Governor Andrew Cuomo has proposed creating a special tax on vapor products sold in New York, amid public health concerns and claims that the use of vapor products has increased among high school students.

As part of the state budget, Cuomo’s proposal looks to expand the definition of tobacco products, which would include vape devices, and subject e-liquid to a tax rate of 10 cents per milliliter—regardless of whether or not the products contain nicotine.

If the governor’s proposal is approved by state lawmakers, the tax would take effect 180 days after the budget is passed.
